Digital Arts GmbH provides the computer software program "Xe847® Photo" and licenses you to use this software according to the terms hereinafter.
(1) You are granted a non-transferable licence to use the above mentioned software program for personal use in your business or profession. Digital Arts GmbH holds the copyright. (2) Therefore you may only copy the program for backup purposes intended to support your personal use of the program. You may not make any other copies, translations or modifications. You must reproduce the copyright notice on any copy or copy of a part of the program merged into another program. (3) You may not assign, sell, distribute, lease, rent, sublicense or transfer the program to another person or organization. You may not reverse engineer, disassemble or decompile the program or otherwise try to decipher the source code or structural framework of the program. (4) This licence terminates if you fail to comply with any provision of this agreement. You agree hereby to destroy the program and all copies of the program or parts of it upon termination. (5) Digital Arts GmbH warrants that the program substantially conforms to the specifications contained in Digital Arts GmbH's promotional material for a period of 30 days from delivery, provided that the program is used for the purpose and with the hardware for which it was designed. (6) Our entire liability is limited to the customers' reimbursement of the purchase price of the software (maximum reimbursement is the suggested retail price as listed by Digital Arts GmbH on the website http://www.xe847.com ) in exchange for the destruction of the program and all copies of the program or parts of it. (7) Any modification of the program other than by Digital Arts GmbH voids the abovementioned warranty. NO OTHER WARRANTIES ARE EXPRESSED AND NONE SHALL BE IMPLIED. DIGITAL ARTS GMBH SPECIFICALLY EXCLUDES ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME COUNTRIES OR STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES SO THE AFORESAID MAY NOT APPLY TO YOU. (8) In no event shall Digital Arts GmbH's liability to you for damages hereunder for any cause whatsoever exceed the amount paid by you for use of the program. In no event will Digital Arts GmbH be liable for any lost profits or other incidental or consequent damages arising from the use or inability to use the program even if Digital Arts GmbH has been advised of the possibility of such damages. (9) This agreement is governed by the laws of Germany applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of Cologne, Germany.
